1. Introduction

These Terms of Use constitute an End User Licence Agreement (EULA) between you and Mindroot Ltd, a company registered in England and Wales (company number 16543299), with its registered office at 71-75 Shelton Street, London, England, WC2H 9JQ.

These Terms govern your use of the Vokab application ("the app") on iOS, macOS, visionOS, and watchOS.

2. Acceptance of Terms

By downloading, installing, or using the app, you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the app.

You must be at least 17 years of age to use the app. By using the app, you confirm that you meet this age requirement.

These Terms apply in addition to Apple's standard End User Licence Agreement for Licensed Applications, available at apple.com/legal/internet-services/itunes/dev/stdeula. In the event of a conflict, these Terms shall take precedence to the extent permitted.

3. Licence Grant

Subject to these Terms, Mindroot Ltd grants you a limited, non-exclusive, non-transferable, revocable licence to download, install, and use the app on Apple-branded devices that you own or control, for your personal, non-commercial use.

All content within the app, including but not limited to dictionary definitions, audio pronunciations, app design, graphics, icons, and branding, is the intellectual property of Mindroot Ltd. "Vokab" and the Vokab logo are trademarks of Mindroot Ltd.

You may not reproduce, distribute, modify, or create derivative works from any content in the app without prior written permission from Mindroot Ltd.

8. Content Disclaimer and Age Restriction

Vokab includes a sexology vocabulary category. All content in this category is strictly educational in nature and is presented in an academic context. The app is rated 17+ on the App Store to reflect this content.

By using the app, you confirm that you are at least 17 years old and acknowledge that such educational content is included.

9. Your Data

Your privacy is important to us. Please review our Privacy Policy for detailed information on how we collect, use, and protect your data. In summary, your learning progress is stored locally on your device and synced via Apple's CloudKit. We do not collect personal information or share your data with third parties.

10. Disclaimer of Warranties

The app is provided on an "as is" and "as available" basis. To the extent permitted by law, Mindroot Ltd makes no warranties, express or implied, regarding the app's accuracy, reliability, fitness for a particular purpose, or availability.

Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015. Under this Act, digital content must be of satisfactory quality, fit for purpose, and as described.

11. Limitation of Liability

To the fullest extent permitted by law, Mindroot Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the app.

Nothing in these Terms shall exclude or limit liability for:

Where liability is not excluded, Mindroot Ltd's total aggregate liability to you shall not exceed the total amount you have paid for subscriptions in the 12 months preceding the claim.

12. Termination

You may terminate these Terms at any time by deleting the app from all your devices and cancelling any active subscriptions.

Mindroot Ltd may terminate or suspend your access to the app at any time, without prior notice, if you breach these Terms. Upon termination, your licence to use the app is revoked.

Sections 7 (Intellectual Property), 10 (Disclaimer of Warranties), 11 (Limitation of Liability), 13 (Governing Law), and 14 (Dispute Resolution) shall survive termination of these Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales.

14. Dispute Resolution

Any disputes arising from or in connection with these Terms shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.

If you are a consumer, nothing in this section affects your right to bring proceedings in the courts of your country of residence.

15. Your Consumer Rights

Nothing in these Terms is intended to override your statutory consumer rights. Under the Consumer Rights Act 2015, you have legal rights in relation to digital content that is faulty or not as described. These Terms do not affect those rights.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms of Use, together with our Privacy Policy and Apple's standard EULA, constitute the entire agreement between you and Mindroot Ltd regarding your use of the app.

18. Changes to These Terms

We may update these Terms from time to time. Any changes will be reflected on this page with an updated "Last updated" date. For material changes, we will update the App Store listing to notify users. Continued use of the app after changes constitutes acceptance of the revised terms.
